Chief Justice David Maraga who gave the lead ruling said; “The presidential election held on August 8 was not conducted in accordance with the constitution,”

This is a rare occurrence as elections are rarely annulled but in this case Maraga stated that the election commission (IEBC) “failed, neglected or refused to conduct the presidential election in a manner consistent with the dictates of the constitution”.
The court has ordered a new poll on November 1, 2017.
Supporters of the opposition party leader, Raila Odinga, came rushing out joyously celebrating the move saying it was justice being served.
“This is justice for us the people of Kisumu. They (police) came to beat and shoot at us when we protested the election results, but now the truth is out,” said Jackson Oduor in Kisumu.
“For the first time we have got justice. They have stolen the election for long,” said fishmonger Lynette Akello.
